Data furnished to me will be used in connection with our own marketing programs, and for no other purpose. I agree that data is furnished on a rental basis only and is for one-time use unless I have paid a fee for multiple use. Data ordered by me will be used for direct marketing use only. I understand that title to any database information or database list remains with the compiler and will not be sold, conveyed or otherwise transferred to other parties.

My marketing material will not make reference to any selection criteria or presumed knowledge regarding the intended recipient of the mail piece.

I will not use the data in connection with the preparation, publication, cleaning or maintenance of any directory of any nature, or posting on the internet. I will not use the data in connection with individual credit, employment or insurance applications. I will not use the data in violation of any federal, state, or local law, rules or regulation or for any unlawful purpose, and make efforts to comply with the Direct Marketing Association's Ethical Use and Fair Information Practices Guidelines.  I agree to comply with both federal and state laws concerning the transmission of facsimile’s.  I understand that any person violating such laws may be subject to civil and criminal penalties, which may exceed $500 for each transmission of any unsolicited facsimile.

Information will be provided from recognized industry compilers of telephone directories and other sources. The Marketing Department (TMD) has no control over the accuracy of such information, and does not guarantee its accurateness or completeness. TMD cannot be liable for loss of profits, or for any other claims regardless of the form of action. TMD's sole liability would be to return the amount paid for the data. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

For ALL ADVO orders:

ADVO lists are for one-time rental use only. Altering the data may affect your postage rates. The list may not be copied, duplicated, transferred, disclosed or retained after the permitted one-time rental use.  The list may not be used for building or integrating into any other databases.
